Reported US Labour Department Action Raises Concerns for Major IT Companies and Global Talent Mobility

Reports that the United States Department of Labor (DOL) has taken action affecting the Permanent Labour Certification (PERM) process for major IT companies, including Cognizant, Infosys, Tata Consultancy Services (TCS), Wipro, Capgemini and HCL, have attracted considerable attention across the global technology industry. The development, reported by media outlets such as Telegraph India, has raised questions about the future of employment-based immigration and the transition from H-1B visas to US permanent residency.

For many years, these companies have played a major role in supporting American businesses by supplying skilled technology professionals and delivering a wide range of IT services. Any restrictions or additional scrutiny affecting their PERM applications could have significant implications for their recruitment strategies, regulatory compliance obligations and the career prospects of international employees. The issue has also brought renewed attention to the broader economic and technological relationship between the United States and India.

Understanding the PERM Labour Certification Process

The Permanent Labour Certification, commonly known as PERM, is administered by the Office of Foreign Labor Certification (OFLC) under the US Department of Labor. It is generally an essential initial step for employers sponsoring foreign workers for employment-based permanent residence under the EB-2 and EB-3 categories.

Under this process, an employer is required to demonstrate that qualified, willing and available US workers cannot be found for the position being offered. This involves meeting prescribed recruitment and documentation requirements, which may include advertising vacancies in newspapers, publishing internal job notices and maintaining records of recruitment activities.

The employer must also comply with applicable prevailing-wage requirements for the relevant occupation and work location.

For IT companies employing professionals on H-1B visas, the PERM process can be particularly important in facilitating the transition towards permanent residency. Consequently, delays or restrictions in processing these applications may create uncertainty for employers and employees alike.
