SCBA and SCAORA Stand Firm in Support of Judicial Independence Amid Calls for Justice Surya Kant’s Resignation

The Supreme Court Bar Association (SCBA) and the Supreme Court Advocates-on-Record Association (SCAORA) have strongly opposed the coordinated demands for the resignation of Justice Surya Kant following oral observations made during proceedings related to the Nupur Sharma case. Their response highlights the importance of safeguarding judicial independence and protecting constitutional institutions from undue public pressure.

The controversy has brought renewed attention to the growing influence of social media in shaping public opinion about judicial proceedings. The associations have emphasised that oral observations made during court hearings should not be viewed in isolation or treated as final judicial decisions. They have cautioned against personal attacks on judges and campaigns that seek to influence the administration of justice through public pressure.

Both legal bodies have reiterated that constructive criticism of judicial decisions is a legitimate part of democracy; however, it must remain distinct from attempts to undermine the dignity and authority of individual judges. They have stressed that judicial independence is essential to the rule of law and that judges must be able to perform their constitutional duties without fear, intimidation or external interference.

The controversy also underscores the need for responsible media reporting, informed public debate and greater awareness of the constitutional procedures governing the removal of Supreme Court judges. Demands driven by social media trends cannot replace established legal and constitutional mechanisms.

The united stand taken by the SCBA and SCAORA reflects the legal fraternity’s commitment to preserving the integrity of the judiciary. Ultimately, protecting judicial independence while encouraging responsible public criticism is vital to maintaining public confidence, upholding constitutional values and ensuring the fair and impartial delivery of justice in India.
