SC rules against CBI probe into Bengal's excess teacher posts.

The Supreme Court quashed part of a Calcutta High Court directive for a CBI investigation into officials behind creating extra posts for 6,861 teachers and staff. These positions were reportedly made to accommodate those who obtained jobs fraudulently. This ruling is a relief for Mamata Banerjee’s administration, as the court rejected the appointments of 25,753 employees last week due to corrupted selection processes.

Chief Justice Sanjeev Khanna stated that the Calcutta High Court was not justified in referring the creation of supernumerary posts issue to the CBI as per the cabinet decision. He emphasized that the court’s comments were only regarding the investigation of the creation of supernumerary posts and did not relate to CBI’s investigations and chargesheets in other areas.

The controversy stemmed from a 2016 test where more appointment letters than vacancies were issued, leading to accusations of illegal recruitment. Following the scandal, the Calcutta HC requested CBI to conduct custodial interrogation if needed. Shockingly, a cabinet-level decision was made to safeguard fraudulent job acquisition.

The state’s counsel argued that the supernumerary positions were created to protect those deprived of a fair selection process. In May 2022, the state decided to create both teaching and non-teaching supernumerary positions. A notice stated that 6,861 supernumerary posts were established under section 19 of the West Bengal School Service Commission Act, 1997 by the Governor.
