Guwahati, Jan 9: The Gauhati High Court ruled on Wednesday that “ups and downs, relationship breakups, and heartbreaking events are coming every body’s life.” This does not amount to incitement for suicide.
The Guwahati High Court granted bail to Raj Kapil Khaound, an accused person who was detained for allegedly aiding and abetting a 30-year-old woman’s suicide in Guwahati on New Year’s Eve.
A mother has filed a formal complaint at the Chandmari police station regarding the death of her daughter in order to obtain justice. Based on the FIR, the police registered a case (Chandmari Police Station Case No. 1/2025) under Sections 108, 69, 61(2), 351(2), and 351(3) of BNS, 2023, and arrested Khaound, who had previously been in a live-in relationship with the deceased.
Advocates Bijon Mahajan and Arshad Chaudhury, who were representing the accused, contended that the arrest was justified on the grounds that Khaound had harassed the deceased’s mind, causing her to become depressed. But they argued that this was not the same as encouraging or aiding suicide.
Mahajan additionally backed up his claim with a ruling from the Indian Supreme Court in the “Kamaruddin Dastagir Sanadi vs. State of Karnataka” case. State of Assam was represented by Additional Public Prosecutor D Das.
After hearing both sides, the Guwahati High Court came to the conclusion that heartbreaks and breakups are normal life events and that they cannot be categorized as suicide instigation.
A bail of Rs 20,000 was granted to Khaound, subject to the Chief Judicial Magistrate of Kamrup (Metro), Guwahati, being satisfied. Meanwhile, the police also detained Manab Jyoti Koch, another accused person who had been living with the deceased for the previous three months, and he is now in judicial custody.
